How to Stay Compliant with Sales Tax: A Shopify Seller’s Guide to US Sales Tax Laws

Thanks to the Wayfair decision in 2018, economic nexus is now the standard, meaning even without a physical presence, you may still need to collect sales tax if your sales surpass a certain threshold in a state. 

Each state sets its own threshold, usually based on either total sales revenue or the number of transactions. For instance, you might need to collect sales tax in a state if you sell more than $100,000 worth of products or make 200 sales there. This can be tricky to track, especially as your store grows, but knowing where you have nexus is the first step in staying compliant. 

 

Multi-State Filing: What You Need to Know 

So, you’ve established that you have nexus in multiple states. What now? Here comes the fun part: multi-state filing. 

Filing in one state is challenging enough, but having to juggle filings across several states? That’s enough to make anyone’s head spin. Each state has its own rules, deadlines, and filing frequencies, and it’s crucial to know them to avoid penalties. 

Here are a few key things to keep in mind: 

  1. Register in Each State: Before you can collect sales tax, you must register with each state’s tax authority. The process varies by state, but it usually involves obtaining a sales tax permit. 
  1. Track Sales by State: Use a system that lets you easily track your sales across different states, so you know where you owe taxes and when to file. 
  1. Understand Filing Frequencies: Some states require monthly filings, others quarterly or annually. Missing a deadline could mean late fees, so keep a schedule handy. 
  1. Be Aware of Special Tax Rates: Many states have varying tax rates based on location (city, county, etc.), and it’s your responsibility to apply the correct rate for each sale. 

While multi-state filing is definitely one of the most challenging aspects of sales tax compliance, the right strategy and tools can make it manageable.

Now that we’ve established how complex sales tax can be, let’s talk about how to simplify the process. 

Shopify has some built-in tax features, but they may not cover all your needs, especially if you’re selling across multiple states. Fortunately, there are tools designed to make tax compliance less painful. 

Here are some top options: 

  • Avalara: This is one of the leading sales tax automation platforms. It integrates directly with Shopify and automatically calculates and files sales tax for you based on where your sales are happening. Filing approval input is needed. 
  • Tax Jar: Another popular option, Tax Jar not only calculates sales tax but also keeps track of when and where you need to file. It generates reports and even auto-files for you in some states. 
  • Shopify Tax: If your needs are simpler, Shopify’s built-in tax tool might be sufficient. It allows you to set up automatic tax calculations based on your location and your customers’, but for multi-state sellers, you might find its limitations frustrating. 

Using tax software can save you countless hours and prevent costly errors, especially as your business grows. No one wants to sift through endless spreadsheets to figure out tax obligations—these tools do the heavy lifting for you. 

 

Consequences of Non-Compliance (Spoiler: It’s Not Fun) 

Now, let’s get to the part everyone wants to avoid: what happens if you’re not compliant? 

In short, it’s not pretty. States take sales tax seriously and ignoring your tax obligations won’t just lead to a slap on the wrist. Here’s what you could be facing: 

  1. Fines and Penalties: Each state has its own rules for punishing non-compliance, but you can expect hefty fines and late fees if you don’t collect or remit sales tax properly. These can add up quickly, especially if you’re late on multiple filings. 
  1. Interest in Late Payments: In addition to penalties, many states charge interest on unpaid taxes. This means that the longer you wait to pay, the more expensive it gets. 
  1. Audits: Perhaps the scariest consequence is the possibility of a sales tax audit. States regularly conduct audits on businesses they suspect of non-compliance, and an audit can be both time-consuming and costly. Even if you believe you’ve done everything correctly, an audit can uncover mistakes that lead to additional penalties. 
  1. Risk to Your Business: In extreme cases, failure to comply with sales tax laws can jeopardize your business. States have the authority to shut down non-compliant businesses or take legal action to collect unpaid taxes. 

The bottom line? It’s far better to stay on top of your sales tax obligations than to deal with the fallout of non-compliance. Trust me—being proactive will save you from a world of hurt later.
